Gambia: Judge Delivers Knock Out Blow To President Jammeh’s Hopes

(JollofNews) – Gambia’s Chief Justice Emmanuel Fagbenle, Monday delivered a final knock out blow to President  Jammeh’s bid to use the courts to stop Adama Barrow from assuming the presidency.

Mr Barrow who was declared winner of last month’s election is due to be sworn-in as third president of the Gambia on Thursday.

But President Jammeh whose mandate ends on Wednesday filed an injunction to the Supreme Court asking it to block his inauguration pending the outcome of an election petition he filed at the Supreme Court against the results.

Mr Jammeh had initially conceded defeat and praised the electoral system as rigged proof. He changed his mind a week later and declared the results null and void citing huge and unacceptable mistakes by the electoral commission.

He later filed a suit at the Supreme Court asking judges to determine that Mr Barrow was not duly elected or returned as president, and that the said election was void.

But the court is unable to hold a hearing until May – as most of the judges come from neighbouring countries – and Mr Jammeh’s mandates ends on January 18th.

And as the date nears, Mr Jammeh again turned to his own appointed Chief Justice, the only Supreme Court judge presently in the country, to make an order of interlocutory injunction restraining Mr Barrow, the Chief Justice of the Gambia or any judicial or quasi-judicial officer or any person in whatever capacity whatsoever to preside over swearing-in or inauguration on January 19th 2017 or any other date pending the determination of the election petition.

But in court today, the Chief Justice declined to hear the motion as it also affects him. He said he will recuse himself from the suit in the interest of fairness.

To the disappointment of  Lawyer Edu Gomez who is representing Mr Jammeh, the Chief Justice also adjourned the election petition suit until the court is fully constituted.

    Mr. JAMMEH, I don’t wish you any good, but there are so many comfortable ways for you to get out of your current dilemma and to secure a peaceful future for The Gambia that I don’t unterstand your petulant behaviour. Think of the time when you have to justify your actions before God and save The Gambia NOW!

  5. I don’t understand why Edu Gomez was disappointed. I am a layman when it comes to legal matters but even I, know that a Judge cannot sit on a case in which they are a respondent. That must surely be litigation 101. Or did he miss that lecture in law school. What a total bell end.

    • Edu Gomez will soon be out of bussiness, cuz no one wont hire him after jammeh. He is not a credible lawyer.

  6. What goes around comes around. Jammeh’s deliberate ignorance to reconstitute the Supreme court has finally come to haunt him. His options now appear to hit a dead end. Barely 60 hours hereafter, the World is going to recognize Adama Barrow as the bonafide President and any attempt to reverse the same will be severely thwarted. Unless Jammeh now constitutionally files his petition and waits for the hearing in May as an ordinary Gambian, all other options are exhausted. What a vicious circle?

  9. This shows the fool – Edu Gomez thought he can manipulate his way through the courts in Jammeh’s favor. Well, The man does not seems to understand the law he profess to be an expert-lawyer. He asked the court to bar Chief Justice from administering Barrow’s inauguration and still expect same Chief justice to rule on this injunction. I guess he must have had too much of liquor while submitting this plea.

  11. God is certainly in control. Man cannot do it but God will simply do it for his own glory. The Gambia is announced free since Dec 1st. We will celebrate that in a grand style for many years. It is true we have enemies from within but surely God will conquer them. Truly, the devil is skillful but God will expose Satan’s foolishness. Jammeh’s regime is over and will not add a second even himself has confirmed that. Keep watching the interesting scene and all the actors. The playwright is behind coordinating. Put on your dancing boots and stop being so much bothered. God has never failed in a battle and it cannot be now! Amen.
