Gambia: Single Mum Remanded In Prison For ‘Insulting’ President Barrow

(JollofNews) – A local magistrate in the Gambia has remanded a mother of several children at the notorious Mile Two Prisons who is accused of insulting the country’s new president, Adama Barrow.

Fatou Badjie of Jabang village is charged with prohibition of conduct conducive to breach of peace. Although the exact words she uttered are yet to be disclosed, state prosecutors said she had intented to provoke a breach of peace.

Ms Badjie, who is also a single parent, was arrested and detained on February 19th by police after she and another woman, Awa Jadama, currently at large, allegedly made rude comments about the president.

Police Prosecutor Sergeant 2202 Fadera, applied for her to be remanded as the matter is still under investigation. He said Ms Badjie may tamper with their investigation or even abscond the jurisdiction of the country if she is released on bail.

“The second accused is still at large and Fatou may equally take the same decision if she is granted bail,” he said.

Ms Badjie, who represented herself in court, denied the allegation and pleaded with the court to grant her bail. She said she is a single parent of several children who are being affected by her absence from home.

Despite her plea, she was remanded by Magistrate AR Bah of the Brikama Court.

The case continues.

    Barrow should call the attention of his tribemate Fula magistrate about the article in our constitution where insulting a “president” like him is a felony. That way the Fula magistrate (AR Bah)would know how to judge what is called “insulting” a president.
    After all, does insulting a person warrant being sent to prison? Then, there are thousands of Gambians who should have been imprisoned for the bitter insults proferred on President Jammeh Babili Mansa.
    The Mandinka-Fula authocracy will soon surface as in the Ex-President Jawara period. I foresee bitter animosity not a sense of burying the hatchet to move forward. Irresponsible figures like Mai Fatty and Fatoumatta Tambajang, who are the most visible at the helm of government should take heed or will soon plunge the country into hatred and more animosity. The witch hunt has already begun. Let’s wait for more dismissals, arrests and imprisonments.
    My clarion call for the APRC militants and stalwarts is NEVER to give in to intimidations and arrests, NEVER to give up their right to oppose a puppet and docile “president” with an incompetent clique of vengeful people. It’s the single most consolidated party that can clearly win the elections.

  5. I think it high time to let people know dictatorship and idolization of African leaders is history and definitely not welcome in Gambia after 22 years of it polluted on Gambians mindset. If this incident is true? whoever (the youths don’t know better hence awaken from 22 year of tyranny and to be enlighten of democratic values) condoned such primitive action is totally undemocratic and seeding intolerance and encouraging blatant barbarism. That means if one is accused of insulting the prophet who careless of it and even befriend people who drew stone on him: means he/she is beheaded too much less a person taken from the street and elected to bring sanity ? You cannot abuse humans being rights because you want to show your sycophancy and loyalty to that person to gain favors and recognition? You are virtually a criminal and a danger to society and humanity and that elected change. period.

  6. Babu Soli, the woman was not charged for insult but her disruptive behaviour which the arresting officer felt was “prohibition of conduct conducive to breach of peace”. That provision of the law has always been in our penal code. Ignorance of the law is never an excuse. Therefore her arrest was legal. She was not the only one whom the officer felt had broken the law. The other woman Awa Jadama is said to be at large which does not help Fatou Badjie’s bail application case. The prosecution had put forward a very strong argument for why Fatou Badjie should be kept in remand. The magistrate has very little room to manoeuvre legally because she has to make her decision based on the facts before her and I doubt it if the woman can raised the surety required to meet bail conditions. Just to let you know the threshold to meet bail application conditions has been increased exponentially by Jammeh. Although Jammeh may have other people in mind when he made that decision however his decision has unintended consequences as it impacts on the entire citizenry. Babu you are contradicting yourself and also displaying a lack of understanding of how the constitution works by calling on President Barrow to talk his “Fula magistrate about the article in our constitution where insulting a “president” like him is a felony” (1) The constitution has provisions that allows the executive to formulate and amend laws through acts of parliament. The penal code is one such law. Therefore you won’t find it in the constitution (2) You referred to the arrest, detention and charge of this lady as the emergence of “Mandinka-Fula autocracy” yet you ask the president to interfere with due process of the law and talk to the magistrate. If president Barrow should ever be foolish enough to attempt that, the Magistrate will be well within her rights to charge him with contempt of the court. I think we all want to move away from the era where politicians dictate to the judiciary. It is only the prosecutor who can drop the charges against this poor woman. And I would like to ask all contributors to this forum to urge the prosecutor to drop all charges against her because it is not in the public interest to carry on with the case. The resources need for this case could be well spent on prosecuting seasoned violent criminals. She should just be given a caution and allow to return to her children.

Period. The woman must be released immediately and she should sue the arresting officer and the State for damages . We did not ask President Barrow to serve us, he volunteered and we chose him, if any Gambian is not happy with his performance, it is our rights to say so. Prosecuting this lady for just alleged breach of the peace is like killing a fly with a sledgehammer. What baffles me most is why she was representing herself. Surely she should be entitled to state provided attorney. There are enough lawyers in the Gambia now to facilitate that. Or has legal aid been scrapped?

  10. Is Da Reality, have you actually read and understand commentaries from “so called” coalition supporters? Because if you did you would not have made the comments you did above unless if you are a person who like to twist and bend the truth. Your attempt to blame the government for the plight of this woman is at best lame and at worst disingenuous. This woman was arrested by a police officer carrying out their duties as enshrined in the law of the land. The arrest, detention and charges brought against her are all within the law. I would suggest you do your research before making comments. If you want to blame anyone for this poor lady’s predicament it is Jammeh you should blame because it was him who brought in the law the lady was charged under. However there is a general consensus that this provision in the penal code is a bad one and we must get rid of it immediately to avoid such incidences in the future. And I am confident that this government will work with the National Assembly to do so. Instead of trying to score cheap political points you should join the chorus for the immediate release of the woman. We can continue with our squabbles later. But for now let us all work together to defend the lady’s right to offend anyone she chooses to. Lets not forget that behind this headlines is a human tragedy, there are innocent children who need their mum.

    Do you really mean to say that woman deserved being sent to Mile II just for insulting a “president”. Which constitutional clause are you referring to? Please state it here. I can’t just believe that the President Jammeh dissidents who have for long “fought” against his “injustice” would now turn a blind eye to unwanton abuse of law by remanding a single mother whose only crime is to “insult” a president. What Gambia are you working to consolidate socially, politically and economically?
    This woman could be brought before the law enforcement agents, adddress her, take her statements, release her until a fair hearing (with a due counsel) is provided. Even then, she could only be reprimanded and fined, but NOT JAILED! That’s absolute abuse of power by the FULA magistrate (AR BAH) to manifest his/her tribal inclination for Barrow.

And the penal code is one such law. There are lots of laws that you will not see in the constitution because the constitution confers the power to create those laws onto other bodies. I have made a very balanced analysis of the situation and have made a very clear call for the release of this poor lady. In fact I have called on everyone to demand her immediate release. I am confident that you do understand what I’ve said so if you want cheap point scoring then it is up to you my brother. Babu if you have been reading my contributions you would have noticed that I have always tried to make balanced analysis of how I see things and that am not driven by sentiments and emotions. I have never and will never hate Jammeh, all I ever wanted is for Gambians to have and enjoy the freedom expression and human rights that we in the west and enjoying. Might I suggest that you put your emotions aside and only look at the facts then you will realised that this has nothing to do with Barrow but a police officer carrying out their duties as enshrined in the law.     The Spokesman of the Transitional Government Halifa Sallah says the recent repealing of the age limit associated with the office of the president and vice president by parliament was unconstitutional and hence called on the Barrow government…
    The Spokesman of the Transitional Government Halifa Sallah says the recent repealing of the age limit associated with the office of the president and vice president by parliament was unconstitutional and hence called on the Barrow government to adhere to the dictates of the 1997 constitution. Mr. Sallah, who has made his position known to the transitional leaders, said government must go back to parliament to table the bill again in the spirit of following the dictates of the constitution. Mr. Sallah told journalists at a news conference today that the amendment of the Election Act, was done in line with the dictates of the constitution, but in regards to the repealing of the age limit for the president and vice president, Sallah said the government got it all wrong.

    “When you dealing with the constitution, you cannot go by section 101. It has a section of its own in the constitution and that’s section 226. So what it says is that when you are to introduce a bill to amend the constitution prior to doing so; you must publish it in the gazette for three months for the first reading. And then publish it again nothing less than ten days; the second publication before introducing it in the national assembly. So that has been made clear after it was done. And there is absolutely no doubt that government sees eye to eye with that particular position and obviously, they will be doing the rectification. So that bill have to be returned to the national assembly for remedial actions to be made,” he said.

    Baa Tambadou, is Gambia’s Attorney General and Minister of Justice. He advice the president on issues of legal matters. He also oversees the passage of bills and amendment of the constitution.

    Mr. Tambadou was absent in parliament on Tuesday, when Interior Minister, Mai Fatty, tabled the proposed constitutional changes. Now Halifa Sallah, is telling Gambians that the recent repealing of the age limit for the office of president and vice president was done unconstitutionally. Sallah said the Barrow government has agreed to make the necessary corrections to rectify the unconstitutional act.

    Commenting on the upcoming national assembly elections, Sallah said he has been instructed by his colleagues to report to Gambians about what has been agreed upon to take part in the polls. Sallah said all the parties have agreed to sponsor independent coalition candidates in the coming polls, except the UDP and the NRP. He said the two parties believed in party sponsored candidates.

    “After lengthy deliberations, the position of the coalition is to participate in this election on the basis of independent coalition candidates, of course two parties have reservations,” Sallah noted.

    Mr. Sallah asked Gambians to continue to be proactive on issues of national importance as manifested in the past elections. He said the opposition came together largely due to public demand for an alliance. He expects the same pressure to be mounted on the opposition in order to do the right thing for the public good.

    Mr. Sallah also said candidates representing the coalition government must be electable and competent, while underscoring the importance of electing competent national assembly members. He said the transition government should endeavor to accomplish its set agenda for change. But he said, this cannot be possible if the coalition’s core mission and values, which brought the opposition together is being set aside.

    “You said Gambia has decided, well we are yet to decide the National Assembly,” Halifa said adding that the other parties should be engaged so that the opposition can win more seats in the coming elections. Once the opposition forms the majority in the house, he said, the proposed reforms and constitutional changes can be accomplished. He warns the opposition to avoid becoming the innocent victims of their own making, while stressing the need for an opposition unity to shape the affairs of the state.

    Mr. Halifa Sallah also clarified that he is not a paid adviser to president Adama Barrow. He said his services are pro-bono.

    “I am not part of the Executive. I am an adviser, but not an Executive adviser. An Executive adviser must receive pay from a government and will be driving government vehicle; given government vehicles and so forth. I am not that. An adviser cannot be with the president 24 hours; every day a week. There are government ministers and ministries who carry out their functions,” he said.

      I applaud President Barrow and his government for their wisdom and magnanimity in coming out and declared that their action was unconstitutional and will be repealed.This is something that all true patriots should be proud of as it is a living proof that Gambia is on a different trajectory from the one of the previous government. That finally Gambians can understand that government can make mistakes but that they are willing to admit it and repeal it if necessary. This scenario is nothing new as it happened almost in all advance civilizations.A point of reference to make here will be President Trump’s travel ban.

      You don’t have to be political scientist to know that Gambia is changing for the better,where the rule of law and good governance will be the cornerstone of our efforts. I will tell you Babu — it was approved by APRC majority house of parliament.Are they also guilty of illegality here? You see Babu,it is easy to mud throw,but reality is a different matter altogether. President Barrow and his government inherited a complete mess in all aspect of our nation’s affairs, and they need support and guidance to stir them unto an oasis of good governance and true brotherhood, and only an insane person would expect that to be an easy task.   18. Babu, can you please tell us where or how Natty Dread is lying? Halifa has said that it was desirable to amend the constitutional provision on the age limit. “However, the Government and the National Assembly must not amend the constitution by relying on the wrong procedure”. This is what Halifa has said according to Foroyaa. Babu, 53 National Assembly members had the opportunity to read and vote on that bill yet none of them realised that a procedural error has occurred. Instead of cheap political point scoring we should be applauding all parties involved for showing political maturity. You will noticed that I have partly dealt with this issue even before you ask me. As Natty Dread said, this government like any other government in the world will get things wrong sometimes and there will be anger, tears and fallouts but we the people can guide them through constructive participation in the democratic process. As Gambians we have two choices; (1) Nurture and fiercely protect our young democracy by working together as one people condemning wrong and praising right whenever we see it, wherever and when done by whomever or (2) Sow the seed of discord by always looking for opportunities to score cheap political points. Babu, I have chosen the first option, which option will you choose?
