Our National Assembly should have gone to work since the morning of its life, to yank from our Constitution all the bad laws….

Unfortunately, it cheery picked and see what effrontery it has given some people…. See what provisions Yankuba Touray is seeking refuge under:

SCHEDULE 2: TRANSITIONAL AND CONSEQUENTIAL PROVISION

Legal Proceedings

(1997 Constitution before the amendment)

13. (1)No member of the Armed Forces Provisional Ruling Council, any person appointed Minister by the Armed Forces Provisional Ruling council or other appointees of the Armed Forces Provisional Ruling Council shall be held liable either jointly or severally for an act or omission in the performance of their official duties during the administration of the Armed Forces Provisional Ruling Council

(1997 Constitution after the amendment in 2001)

13. (1) No member of the Armed Forces Provisional Ruling Council, any person appointed minister by the Armed Forces Provisional Ruling council or other appointees of the Armed Forces Provisional Ruling Council shall be held liable or answerable before a Court or authority or under this Constitution or any other law, either jointly or severally, for an act or omission in the performance of his or her official duties.

Can you spot the differences between the two provisions quoted above?

Jammeh and his rubberstamped APRC parliament injected these in this provision in 2001 “…..or
answerable before a Court or authority or under this Constitution or any other law…..” and deleted ‘….during the administration of the Armed Forces Provisional Ruling Council’

And then the daring-do of the Junta

Section 17:

“The National Assembly shall have no power to pass a Bill to amend or repeal this paragraph or paragraph 11, 12, 13 or 14 of this Schedule”

And Section 14: Preservation of Confiscation and Penalties imposed by the Armed Forces Provisional Ruling Council.

‘Any confiscation of any property or any other penalties imposed by the Armed Forces Provisional Ruling Council or the Chairman thereof shall not be questioned or reversed by any court or other authority under this Constitution or any other law.’

Crazy!!! They immunized themselves from every act of omission or commission and have the effrontery to deny justice to those whose properties were seized….

I just wished our current National Assembly had yanked these provisions out in the morning of its life…. I wished….
