
(JollofNews) – Leaders of the West African regional bloc Ecowas, the African Union and the United Nation are accused of failing to stick to the terms of an agreement they signed to facilitate former Gambian ruler, Yahya Jammeh’s peaceful exit from power.
Mr Jammeh, 52, who governed the Gambia for 22 years, was booted out of power in January 2017 after a shock defeat in the presidential election by opposition candidate Adama Barrow.
As part of the deal and ‘in order to assist a peaceful and orderly transition and transfer of power and the establishment of a new government,’ Mr Jammeh agreed to temporarily leave the Gambia on 21 January 2017 for Equatorial Guinea with his wife and family ‘without any prejudice to his rights as a citizen, a former president and a political party leader.’
In return for his peaceful exit, regional leaders, the AU and the UN gave assurance to Mr Jammeh while he is in exile, they will work to ensure that host countries that offer “African hospitality” to him and his family do not become undue targets of harassment, intimidation and all other pressures and sanctions.
They also gave him assurance that they will work with the Government of the Gambia to prevent the seizure of assets and properties lawfully belonging to him or his family and those of his cabinet members, government officials and party supporters, as guaranteed under the Constitution and other laws of the Gambia.
Ecowas, the AU and the UN also assured Mr Jammeh they will work with the Government of the Gambia to ‘ensure that he is at liberty to return to the Gambia at any time of his choosing in accordance with international human rights law and his rights as a citizen of the Gambia and a former head of state.’
They also gave their commitment to work with the Government of the Gambia to ensure that it fully guarantees, assures and ensures the dignity, security, safety and rights of Mr Jammeh’s immediate family, cabinet members, government officials, security officials and party supporters and loyalists.
Further assurance was given to Mr Jammeh by the organisations that they will work with the Government of the Gambia to ensure that no legislative measures are taken by it that would prevent the seizure of his legally acquired assets and his return to the Gambia.

Despite the assurances, the Gambian regime Monday obtained a court order to temporary freeze all properties belonging to Mr Jammeh.
The order will affect Mr Jammeh’s companies or organisations directly associated with him and is meant to prevent him from liquidating or dissipating his assets so as not to cause prejudice to the state should there be adverse findings made against him by a court which may require the recovery of assets and money from him.
But according to an influential heavyweight in Mr Jammeh’s APRC party who contacted JollofNews, regional leaders including (AU) and the UN have not done anything to stop the persecution of Mr Jammeh’s family members in the Gambia and senior security officials in his regime.
“HE [Yahya Jammeh] has done everything they asked of him as part of the deal but ECOWAS, the AU and the UN are not fulfilling their side of the deal,” the official who preferred anonymity said.
“This is really disappointing. HE had the best interest of Gambians when he agreed to step down from power. He could have stayed put and fight to the last drop of his blood, which would have caused untold sufferings, death and destruction to our country.
“ECOWAS, the AU and the UN should start putting pressure on Adama Barrow and his government to stop the persecution and harassment of HE, his family and security officers in the best interest of the Gambia.”

Well we now know that there was an alleged agreement between the parties. The terms and conditions being explained by an anonymous party member. The article also claims that the said agreement saved many lives. If the said agreement was in writing and signed by all the signatories, then it becomes a legal issue for argument by legal representation. In such circumstances one can understand the aggrieved party taking issue over what he perceives as entitlement to the rights given by the alleged agreement. The Gambian government may feel they have a right to freeze all assets until all claims are settled.
Such legal arguments can take many years to resolve. Litigation in such cases can be very expensive indeed. Obviously all parties will take legal advice as to the merits of their claims.
Meanwhile I think many victims who suffered may have a soundly arguable case for compensation against the State; The State has a duty of care to all citizens and noncitizens under their jurisdiction.
These matters are best left to the Judges; Mr Jammeh has withdrawn his claim for dispute over The Presidential Election reported to be for the best interests for peace and harmony of The Gambia. The further claim that Mr Jammeh left The Gambia for similar considerations is also claimed. Meanwhile the State may have a duty of care to maintain and protect any property claimed or in dispute. I agree with Dr Sarr in that Yahya Jammeh is entitled to all rights as a Gambian citizen.

By refusing to accept a constitutional declaration, Jammeh violated every right and lost every form of sympathy from the Law. By illegally usurping power and illegally acquiring properties in the most fraudulent manner, I am deeply disappointed that you have given credence to Jammeh’s story.
He was a criminal and should be treated as such. Jammeh committed numerous atrocities and cannot be protected from some bogus agreement that he negotiated with outsiders. I was a senior member of the Gambia Armed Forces and I know that Jammeh left for his own interest. He fully well understood what was coming for him when seven commandos stood right in front of him and kept on reminding the Guinea Conakry president that it was time. He (Jammeh) and any of his enablers would have been the victims of the blood bath, just like Laurent Gbagbo in Ivory Coast. I am disappointed he ran, he should have stayed and fight as he had been bragging. I know Jammeh since school days and in the Armed Forces and me and him were bodyguards to Sir Dawda for some years. Headline: “Ecowas leaders accused of betraying Jammeh”. Accused by whom and who is the lamenter? The few points quoted from an unknown person barely give credeance to the vilifying headline. I think the headline is grossly inappropriate.

The agreement would seem to offer protection for Mr Jammeh, His family members, His APRC Minister’s, Supporters and what is more interesting protection of his security officials. Mr Jammeh as a citizen of The Gambia is entitled to all rights and is free to enter Gambia at anytime of his choosing. His property and assets are also apparently protected. In the meantime several security officials have been charged along with family members and Mr Jammeh’s Gambia assets frozen by The State. The Governor of the Central Bank has also been replaced. President Barrow claimed in the French media { France 24 } that 4 Billion dalasis { about 80 million dollars} was unaccounted for, from State Coffers. The allegation also states that “African hospitality” was assured with no sanctions or threats or harassment to the Host Country. From which Mr Jammeh conceded The Statehouse and left the country temporarily and voluntarily to facilitate a peaceful transition of power. With no damage to infrastructure and no loss or injury of ECOWAS citizens lives.
It is therefore up to all sides to provide proof or counterclaim, to this comprehensive allegation. Or reach an amicable agreement.
The victims of crime is a separate issue against The State. Of course for a crime to be committed, there must be a criminal. This cannot be a trial by the media. The writer is contradicting himself. He/she said, “properties legally acquired”, and also that he will be guaranteed his liberties. The government of the Gambia is basing its decision on the grounds of illegal withdraws Jammeh made whilst in office, and therefore have the rights to recover those funds belonging to the state regardless of any guarantees any organization. On the issue of Jammeh being shielded from prosecution, Jammeh is a Gambian, and therefore have rights and protection just like any other Gambian, but if he is implicated in any of the murders and tortures of Gambians, the state will seek to prosecute him just like any of the members of the Jungullars that served him, regardless of guarantees

There was neither agreement nor deal by Ecowas for Jammeh to leave the country. He was told to leave or face the music .I’m glad that one of most cowards ever to be enlist in our military,Yaya Jammed choosed the proposed exit. There was no betrayal here whoever thinks so that person betrayed the family of Solo Sanding, Dayde Hydra and the list goers on and on.Finally it’s the duty of every Gambian media platform to protect the new democracy that took us 22 years to establish by ignoring and refusing to publish such stories. I’m a freelance writer and it hurts me when I see such stories. The world now is far more democratic than yestryears. It was democracy that we wanted the UN,ECOWAS and the AU has done that to remove a man the majority of Gambians don’t want as their president. Every criminal has rights except Yaya Jammeh and whoever think so that person is not a Gambian.
No one is perfect….let them confess and be prepared to repent and justice can and will take its course.

This new government of The Gambia is one bomboclart greedy pussyhole connection. All they did is fake the Gambian people that they can take over the power and now they are stealing the former president assets, cars, lands, cows etc., waste the Gambian money (Barrow and the Ecowas soldiers are living in the Kairaba Hotel, imagine what this costs in a day!) and sell out the country to Chinese and other cunts. You Gambians better wake up out of your stupidity! Yaya Jammeh was protecting The Gambia, while this new president will sell it out to Senegal, China and others. Gambling and all kind of nonsense got legal again. They all were only jealous of what Yaya Jammeh had and could not take advantage of the country and other people while he was president. This ridiculous Barrow is even driving Yaya Jammehs car, but talking bad about. What the fuck is wrong with Gambians! I promise you that this country will drift into violence, tribal war and criminality under that new government. It is really sad what Gambia has become since Yaya Jammeh left.
